How To Access Arrest Logs, Mugshots & the Reason for Detainment in Delaware County

A person can search public records to find valuable arrest and inmate information. The two primary options for gathering this information are to look up inmates incarcerated at the Delaware County Jail or to obtain arrest and police reports from local law enforcement agencies.

If you want to cast the widest net when looking for Delaware County arrest records, your first option is to perform a search at the county level. Here, you can gather arrest and inmate information throughout Delaware County. Searching at the county level is a great option for getting inmate information if you have the person’s name.

Gathering information with local law enforcement is a good option in several situations. First, you may only have vague details about the person, but you have information on the arrest location and date. In this scenario, your best option may be to contact the local law enforcement agency responsible for policing that location.

Another reason may be that you need a detailed arrest report, which the arresting agency will likely maintain. Finally, local law enforcement is a great option if the person you are searching for was recently arrested, as information may not be available at the county level yet.

Track Down Someone Who Was Arrested in Delaware County Indiana

A person can search for Delaware County inmate information using the Sheriff’s Office Jail Records Search Tool.1 A person can search this public index by name for general inmate information.

After entering a person’s name, you can view their inmate number, booking date, scheduled release date and bond amount, if applicable. The inmate information does not provide any specific information on the basis for their arrest or the charges brought against the person.

General: Here, you can view the level of the offender they are classified as (e.g., sex offender, sexually violent predator etc.) when they were required to register as a sex offender and the end date (if applicable).

Physical Description: This section provides a detailed description of the person’s physical characteristics, including specific information on the person’s scars and tattoos.

Address: Interested parties can refer to this section, which includes their complete address and a link to view their location on a map.

Offenses: This section briefly summarizes offenses, including a description and the date they were convicted. Since this is a registry of people currently living in Indiana, it is possible they committed these violations in other states. This section also provides the state they were convicted and the case number, which you can use to look up the person’s complete criminal record.

Check for Arrests via Local Police Departments (Or Request Police Reports)

Delaware County public records also include arrest reports provided by local police departments. 

To get detailed arrest and police reports, you will want to focus your search on local police departments in Delaware County. If you know the arresting agency for the person you are searching this should be a fairly straightforward process. However, if you need more information, you may have to check with multiple police departments.

Be aware that there is no uniform process for requesting police and arrest reports. Search the police department’s website or call them to understand better how to request records with them.

How To Obtain Free Delaware County Indiana Criminal Records

In addition to arrest and inmate information, you can search public records in Delaware County for a person’s complete criminal history. While the arrest records may show why a person was arrested or where they are incarcerated, it does not provide the level of detail that can be found when you look up someone’s criminal record.

For instance, criminal records will contain detailed information about the case’s final disposition and sentence. The docket entries will specify every event that happened with a particular criminal case starting from the arrest or warrant.

In addition, criminal records can be used to see whether a person has any warrants out for their arrest or is currently on probation. Criminal records can be obtained through background check reports, online databases of Delaware County court records and in-person searches.

The below sections will highlight how you can perform a free criminal record check and how you can look for specific information.

Perform a Free Public Criminal Record Check in Delaware County Indiana

You can use the Indiana Courts Unified Case Search Tool to locate Delaware County criminal records. This tool can be used to find criminal records as minimal as citations to convictions for first-degree murder.

To perform a search, you first need to ensure you only include criminal records in Delaware County. To do that, first select one of two Delaware County Courts in the drop-down option. Then, below the Court selection is an option to limit searches to a particular type of case.

Here, you only want to check the “Criminal & Citation” option.

After you have set your parameters, you are free to enter your search criteria, whether that be the person’s name, case number or the attorney that represented them. If you click on the advanced search option, you can also choose to search by case status (open or closed) or set a file date range.

Most people will be performing a name search. This type of search also allows you to enter the person’s date of birth. In addition, you can enable a “sounds like” option if you are not sure as to the exact spelling of the Defendant’s name.

Once you execute a search, the results will provide you with the following general information: the caption of the case, case number and court where the case was tried. You can also see the type of criminal case (e.g., misdemeanor, felony etc.) and the date the case was filed. Finally, the summary will also provide the current status of the case along with the charges that were brought against the Defendant.

You can get additional details once you click on a person’s criminal record. Here, you can see a listing of all charges brought against the Defendant, along with the relevant statute and degree of the offense.

Next, you can see a Chronological Case Summary detailing everything from the arraignment and preliminary hearing to the final judgment and disposition of the case.

Finally, the criminal record contains detailed financial information. This financial information includes court costs, filing fees and fines. The information will provide both the amount billed along with transaction details as to what has been paid and what is still outstanding.

An alternative option to the online search tools is to search for cases in person. Searching in person is a good option if you need additional assistance. Also, many times, record custodians have additional information you can search in person that you cannot view online.

There are two options for searching criminal records in person in Delaware County. First, the Delaware County Circuit Court has jurisdiction over felony cases.

Also, you can search for records with the Muncie City Courts for criminal misdemeanor cases. They have jurisdiction over misdemeanor criminal cases throughout Delaware County, not just in the city of Muncie.

How To Check for Arrest Warrants in Delaware County Indiana

The quickest online option to search for Delaware County Warrants is by using the Indiana Courts Unified Case Search Tool.4 This search tool contains, among other types, criminal records. These records can be used to perform a warrant search for a particular person or case.

To find warrant information, first follow the instructions for narrowing your search to criminal records in Delaware County. From there, enter the search criteria for the person you want to look up warrant information about.

Once you have accessed the person’s criminal record, you can find warrant information by navigating to the “Chronological Case Summary” section. Here, you will have a comprehensive list of all events, court dates and judicial decisions.

If a person had a warrant issued, it will be listed in this section along with any related information. Often, this includes bond information or the reason the warrant was issued.

Another alternative is to look through the Delaware County Sheriff’s Office Most Wanted List.5 Here, you can find someone’s mugshot, a physical description of the person, along with their address. How To See Who Is on Probation in Delaware County Indiana

A person wanting to look up probation information can search someone’s criminal record using the Indiana Courts Unified Case Search Tool.

After you find someone’s criminal record, you will need to know where to locate probation information. While this search tool does not provide a sentencing section, you can find sentencing information in the Chronological Case Summary.

When you navigate to the Chronological Case Summary, scroll to the bottom and work your way up, looking for the sentencing information. Here, you will find any probation information if it was part of the person’s sentence. Included should be the date the probation was issued and the total length the person must serve.

How To Conduct a Background Check in Delaware County Indiana

In addition to online and in-person searches, Delaware County public records can be obtained by requesting a background check report. Requesting a professional background check is done for different reasons than searching records yourself online and in person.

Conducting your own search is commonly referred to as a personal background check. These types of background checks are not typically done for a specific purpose, but rather, are conducted to learn more about a person. This could be gathering information about a friend, neighbor, co-worker or more.

However, when you request a professional background check, it is usually done for a specific purpose. For instance, a person may be requested to consent to a professional background check if they are applying for a job or requesting to rent a property.

Sometimes, a background check is needed because of state or federal laws. This is the case for people volunteering to work with certain vulnerable groups (e.g., children, elderly) or to apply for special privileges such as a security clearance or firearm license.

Even within professional background checks, there is a degree of variance depending on the purpose. A basic background check is conducted using a name-based search (Level 1). The scope of the search is typically limited to the jurisdiction of the agency providing the services.

A more detailed background check is fingerprint-based (Level 2) and typically searches criminal records throughout the person’s state and can even include the entire United States.

To obtain a background check in Delaware County, you can receive a limited criminal history check if you live in an unincorporated area of Delaware County (not in a city or town). Outside of this limited option, you can request a limited criminal history background check through the Indiana State Police.6 The background check provides Indiana criminal records involving felonies and misdemeanors.

Requests can be made through their online portal or by mail. To make a request online, simply click “Start search” for their online portal and create an account. From there, you can log in and provide the requested information.

A searcher also has the option to search Indiana public records to get a more thorough understanding of a person’s criminal history. The records maintained by custodians in Delaware County will not indicate whether a person has been convicted of crimes in other parts of the state.

Indiana Sex & Violent Offender Registry – Provides individuals with the ability to search for registered sex offenders throughout the state of Indiana. The tool allows you to select a particular county in Indiana to perform a search of registered sex offenders in that area.

Indiana Department of Corrections Incarceration Search – Search by name for people incarcerated in Indiana. This search tool provides detailed information about the individual, the charges they were convicted of and their sentence.

Federal Bureau of Prisons (BOP) Inmate Search Tool – Conduct a name-based search to find inmates incarcerated in federal prisons from 1982 to the present.8 You can also search by an identifying number (e.g., FBI, BOP etc.) if you have that available.

Department of Justice Sex Offender Search Tool – Perform a comprehensive search of the sex offender registries of all 50 states as well as other territories belonging to the United States.9 Individuals can perform a search by either a person’s name or address (including either a 1, 2 or 3-mile radius).

How To Look Up Delaware County Court Documents & Cases

If you are looking for an online directory of all types of Delaware County judicial records, you can search with the Indiana Courts Unified Case Search Tool.

To perform a Delaware County case search, make sure to select one of its two options under the “Court” drop-down menu. This would be either the Delaware County Circuit Court or Muncie City Court.

Here are the types of cases and court records you can view online using this tool:

Criminal & Citation: These cases will include citations (e.g., traffic tickets), misdemeanors and felony cases.

Civil: This includes a wide range of cases in which one party is suing another party for damages. Typically, these damages are monetary. Examples of cases include matters involving property damage, breach of contract, personal injury, negligence, defamation, medical malpractice and more.

Family: These cases are limited to issues involving the family unit. Cases include divorces and matters involving alimony, child support and custody.

Probate: These cases revolve around the administration and distribution of assets that are part of a decedent’s estate. Cases might involve a person disputing the validity of a will, challenging an executor’s actions and other related matters.

Appellate: These are strictly limited to cases that were fully adjudicated and then appealed to a higher court for further review.

How To Acquire Delaware County Vital Records (Marriage, Divorce, Birth & Death Records)

A person can also check public records to find out if someone is married or divorced and when someone was born or died. These records are commonly referred to as vital records.

These vital records are another tool to learn more about a person, perform genealogy searches and more.

There are also times when you will be required to provide someone with a certified copy of one of these vital records. It could be for insurance purposes, to administer an estate or for other types of legal or business reasons.

While many of these records may be viewed by the general public, there are various rules for obtaining certified copies. Below is information on how to search for these records. In addition, you can learn about how to request certified copies and any restrictions you may face.

Locate Marriage & Divorce Records or Certificates Through the Indiana Courts or Delaware County Clerk’s Office

Delaware County marriage records are publicly available in Indiana. For marriages from 1993 to the present, you can check if someone is married using the Indiana Court’s Marriage License Lookup.10 When performing a marriage record search, the only information you need to provide is the name of either party to the marriage.

After you enter the person’s name, make sure to select “Delaware” for the County Issued. You can also set a marriage range to further narrow down your search results. The search results will provide you with the marriage partners’ names, the marriage date and the county they were married.

If you click on a particular marriage record, you can also view the marriage officiant and marriage license number. This may be helpful if you need to request a copy from the record custodian.

To receive a copy of a marriage record, a person will have to make a request with the Delaware County Clerk. You can view marriage records at the Clerk’s Office from 1920 to the present. Marriage records between 1827 and 1920 are only available on microfilm.

A non-certified copy of a marriage record is $1.00, and a certified copy is $4.00. To make a request, you can complete their Marriage License Copy Request Form and drop it off or mail it to the address below:

If you are looking to locate Delaware County divorce records, the most direct option is to use the Indiana Courts Unified Case Search Tool.

Using this tool, you can search for divorce records by name, case number or attorney. First, select Delaware County under the Court drop-down menu. Then, select “Family” under the option to limit your search to certain types of cases.

Now, you can enter your search information and view your results. The snapshot will provide you with the case caption, court, filed date and more. For a detailed case summary, click on the case caption.

Here, you can view a chronological history of the case from when one party filed a petition to when the judge issued the divorce decree. You can also see information on both parties to the divorce and financial information related to court costs and filing fees.

A non-certified copy is $1.00, and a certified copy will cost $4.00.

An online option for requesting a copy of a marriage or divorce record is to make a request with VitalChek. They are an approved third-party vendor for Indiana vital records.

Certain marriage and divorce records can also be searched through the Legacy Search Tool provided by the Indiana State Library.11

Find Births & Deaths in Delaware County Through the Health Department Vital Records Division

A person can request a birth certificate or death certificate through the Delaware County Health Department Vital Records Division. However, birth records are only available to the general public if the person is deceased and it’s been at least 75 years since the certificate was issued.

To receive a copy of a birth certificate without meeting those parameters, you must be one of the following people:

  • Parent
  • Grandparent
  • Siblings (at least 18 years old)
  • Children or grandchildren (at least 18 years old)
  • Spouse
  • Stepparent
  • Uncle or Aunt
  • Attorney (proof of direct legal interest required)
  • Government agencies (for official business purposes)

To request a record, you must first complete either an Application for a Birth Certificate or a Death Record. Other items that must be submitted include a copy of your current government-issued ID, payment, self-addressed envelope (if mailing) and any documentation that supports your relationship with the person listed on the record.

Both birth and death certificates cost $20.00. Their hours of availability for the Delaware County Health Department are Monday through Friday from 8:30 AM – 4:00 PM. For additional information, you can call them at 765-747-7721.

You can also request either a certificate of birth or a certificate of death from the Indiana Department of Health.13 They have birth records beginning in 1907 and death records starting in 1900 to the present. How To Determine Who Owns a Property or Home in Delaware County Indiana at No Cost

Citizens’ Rights & Responsibilities Regarding Delaware County Public Records

You are now equipped with the tools and resources to effectively search for all kinds of public records. However, understanding public records does not end with knowing how to find them. As citizens, you have a moral, ethical and legal responsibility to know how you can use these records.

You also have rights, both as a searcher and person being searched. For searchers, you have the right to access public records not subject to any state or federal exemptions. While this doesn’t mean the way to access these records is always straightforward, it does mean that government agencies must be responsive to any inquiries for public records.

If they are not available online or for in-person searches, you can usually access these records by submitting a FOIA request.

For personal use, you can access and view these records however available without requesting the consent of the person you are searching. A searcher just needs to make sure that they do not use any public records as a tool to engage in criminal behavior.

Federal Trade Commission (FTC) – A person being searched can file a report with the FTC if a background check was conducted on them without their consent, or negative action was taken against them, and the person conducting the search failed to provide the required notices.

Equal Employment Opportunity Commission (EEOC) – Anyone who was discriminated against due to information from their background check may have the right to file a claim with the EEOC through their online portal.17

Fair Credit Reporting Act (FCRA) – The FCRA has a set of requirements for when you are checking a person’s consumer information. Here are some examples of rights afforded by the FCRA:

  • A person can ask for their credit score.
  • A person can dispute information they believe is incomplete or inaccurate, and the consumer reporting agencies must remove or correct this information.
  • A person has a right to know what is in their file.
  • A person must be told if information in their file was used against them (e.g., declining a person’s rental application because of a low credit score or unpaid debts).
