Indiana State law allows its citizens access to public records prescribed by the Access to Public Records Act (State code 5-14-3).1

Unless records held by all levels of government in Indiana are deemed restricted to the public, records may be searched and inspected by any member of the public, including arrest records and mugshots.

Arrests may be executed by law enforcement agencies at all jurisdictional levels, including federal, state, county, and municipal. Each level is designed for different law enforcement objectives and provides different law enforcement services that others may not. For example, local police departments are tasked with enforcing local traffic laws, while federal law enforcement agencies concentrate on fighting interstate criminal activity.

When an arrest is made at any law enforcement agency level, it is typically the county-level agency that provides detention services and jail facilities. Especially in a county such as Delaware County, Indiana in which there are no large cities or metropolitan areas.

Consequently, there are no large municipal police departments that operate detention centers within the small townships in Delaware County.

The Delaware County Sheriff’s Department operates the county jail facility. Once an arrest is made in Delaware County, regardless of what law enforcement agency makes the arrest, the booking process takes place at the county jail. This is where the arrest record originates, and the arrestee is now classified as an inmate of the county jail.

Wherever the arrestee’s case leads after being apprehended, the arrest record will be maintained by the Delaware County Sheriff’s Department as a result of the booking taking place at the county jail.

Additionally, the police incident record will be maintained by the agency that executed the arrest if it is an agency other than the county Sheriff’s Department, such as a local police department. As the case makes its way through the judicial process, the arrest record is included as part of the criminal court case record.

The Delaware County Sheriff’s Department’s public website provides a free Inmate Search Tool for looking up current inmates in custody at the county jail.2 From the search webpage that initially opens, a search can be initiated by entering a first and/or last name.

Or clicking on the “Show more” link will display a list of the most recent arrestees booked at the jail facility.

After a few seconds of opening the inmate lookup search page, the expanded list of the most recent arrestees automatically pops up. The data fields included in the list are inmate number, first name, middle name, last name, booking date, scheduled release date, and the total bond amount. Clicking on the “Show more” link again expands the list.

If the specific person being searched is not on the list, a name can be typed into the search field and a single record is retrieved for the person specified.

Clicking on one of the records on the list brings up a pop-up box with additional information on the record, including the statute of the charge, a description of the charge, the case number, and the status of the case.

The online record does not include mugshots. To obtain the full police report with the mugshot from the Delaware County Sheriff’s Office an access to Public Records Request which will be covered in the subsequent section of this article.

As already mentioned, there are no large cities or metropolitan areas in Delaware County. Consequently, all arrests executed by local police departments for the small townships within Delaware County book the arrestees at the county jail.

The Township of Yorktown is the largest township in Delaware County. The Yorktown Police Department does not operate a jail facility.3 However, if a Yorktown police officer executes an arrest, the department will maintain a police and arrest record. The department can therefore be queried about relevant arrest records.

The Yorktown Police Department’s public website does not provide online search tools. A request for information regarding arrest records will need to be made via telephone or in person using the following location or phone number information:

While information obtained via government resources is usually reliable, there are multiple non-government services such as VINELink that offer search tools for a fee to achieve the same results.

The public record search resources described above work best for recent arrests. For prior arrest records that are not recent, a different type of search is needed.

Retrieve Information on Prior Criminal Activity & Arrests Made Within Delaware County Indiana

Up to now, this article has outlined methods to search and obtain information on recent arrests.

To get older arrest records from the Delaware County Sheriff’s Office or the Detention Center, an access to public records request will be required.4 A Public Records Request Form needs to be filled out and sent in.5

The procedure is very similar for making access to Public Records Request to the Yorktown Police Department. However, the Yorktown Police Department charges $15 for issuing reports. Requests can be made by phone, mail, or in person.

For prior arrests of which the resulting court cases have already been through the judicial process, a different approach for obtaining older arrest records may be taken. Although the original arrest records will remain on file with the law enforcement agency and detention facility from which the record was originated, they will also be consolidated into the court case record. Therefore a search of court records may yield fruitful results.

The Delaware County Clerk of the Courts public website provides a link that is labeled “Online Court Records at My Case” and leads to an online search tool that is used to search court cases at all levels throughout the entire State of Indiana.6

The database is maintained by the Indiana Judicial Branch. The “Court” drop-down field allows users to narrow the search to Delaware County.

Initiating a search only requires a first and/or last name. The more data fields that are filled in, the more specific the results will be. The search retrieves a list of records that match the search criteria.

Once the record is found and a case number is obtained, a copy of the record can be requested via the Delaware County Clerk of the Courts. A Court Records Request Form needs to be filled out and submitted by mail along with a self-addressed stamped envelope.7

Delaware County does charge a fee for court record copies of $1.00 per page, plus $3.00 per document a certification is required.

After the traumatic experience of being arrested, getting released from custody becomes a matter of utmost importance. This, however, is not an activity that most folks are familiar with.

How To Cover Bail in Delaware County (An Overview)

Within 24 to 48 hours of the arrest taking place, an initial hearing (also referred to as an arraignment) is set. At the indictment, the bail amount that will need to be posted by the defendant (formally known as the arrestee) will be determined by the judge.

For first-time non-violent offenders, the judge may decide to release them on personal recognizance. This means that the bail amount is zero. For offenders with prior arrests of more serious crimes, the bail amount is based on the defendant’s criminal history.

For those defendants who are offenders of repeated violent crimes and are deemed as a flight risk by the judge, bail is much higher or maybe altogether denied. All defendants have the right to legal representation by an attorney at the hearing.

If the defendant has the financial resources on hand to pay the bail amount in full, it may be paid at the court. It may also be paid at the detention facility. The judge may, at their own discretion, require that only a percentage of the bail be paid by the defendant.

The services of a bail bondsman to obtain a surety bond may be used by defendants that don’t have the financial means to pay the bail amount in full. The bail agency puts forth the total bail amount for a fee, sometimes as high as 20%. Collateral in the form of a home or other valuable assets may be required.

If the ordered court appearance is missed by the defendant, a forfeiture of the bail to the court is effected. If the defendant appears in court as mandated, bail funds are refunded at the end of the court proceedings, minus amounts for fines and restitution for guilty verdicts or pleas.

In Delaware County, the local police departments use the county’s jail, making the indictment and bail procedures the same for all.
